Misc. application No.2/2022 filed by the respondents for

early hearing of the case stands allowed.

Learned counsel for the respondents submitted that the issue

involved in the present writ petition is squarely covered by the

decision passed by the Apex Court in the case of Sumtibai and

Ors. Vs.Paras Finance Co. reported in (2007) 10 SCC 82.

Learned counsel for the respondents has also placed reliance

on the order passed by the co-ordinate Bench of this Court in the

case of Gurupal Vs. Addl. District Judge (Fast Track) No.2,

Alwar and Ors. reported in 2011 SCC Online Raj. 1752.

Learned counsel for the petitioner Ms.Sonal Singh wants time

to go through the said judgments and further wants time to

address this Court.

List the matter on 09.09.2022 for final disposal at this stage.
