This writ petition has been filed by the petitioner

being aggrieved with the action of the respondents of

rejecting his candidature for the reason that he was not

in practice for a period of not less than seven years on

the last date of submission of application. The rejection of

petitioner's candidature is in accordance with the

(2 of 2) [CW-8541/2022]

provisions of Rule 33(iii) of the Rajasthan Judicial Service

Rules, 2010.

As per the case set up by the petitioner, he was

enrolled as an advocate on 7.7.1997, however, his name

was under voluntarily suspension of practice from

5.10.2009 to 13.4.2019 and he resumed his practice on

14.4.2019.

Admittedly, the petitioner is not having experience of

practice for a period of not less than seven years on the

last date fixed for receipt of applications.

Having heard learned counsel for the parties and

after going through the averments of the writ petition, we

are of the view that there is no illegality in the action of

the respondents in view of the judgment of the Hon'ble

Supreme Court in the case of Dheeraj Mor Vs. Hon'ble

High Court of Delhi, reported in (2020) 7 SCC 401.

Hence, there is no force in this writ petition and the

same is dismissed as such.

Stay petition is also dismissed.
