Judgment / Order

22/04/2022

1. Counsel for the petitioner had earlier preferred D.B. Habeas

Corpus Petition No.83/2022 in which direction was given to the

petitioner to deposit a sum of Rs.25,000/-.

2. It is contended by counsel for the petitioner that at that time

petitioner was not having sufficient fund to comply with the order,

therefore he withdrew his petition.

3. It is also contended by counsel for the petitioner that the

corpus executed an agreement to marriage with the petitioner.

Thereafter, she has been taken away by non-petitioner No.4.

4. This Court is alive of the fact that corpus is a major and

there is possibility that she has gone on her own free will, hence,

we deem it proper to direct the petitioner to deposit a demand

draft of Rs.25,000/- drawn in favour of Registrar (General)

Rajasthan High Court, Jaipur Bench, Jaipur with the Registrar

(Judicial).

5. Issue notice to the respondents.

(2 of 2) [HC-115/2022]

6. Learned Deputy Government Advocate accepts notice on

behalf of respondent Nos.1 to 3.

7. Office is directed to issue notice to the remaining Respondent

No.4.

8. Counsel for the petitioner is directed to supply copy of the

petition alongwith receipt of the deposit of amount in the office of

learned Deputy Government Advocate.

9. On depositing of the amount and furnishing the proof

thereof, learned Deputy Government Advocate shall ensure that

the corpus is produced before the Court on the next date.
