The present contempt petition is heard as if the
main matter is argued for the reasons that certain documents
were required to be examined as to what was the pay scale
attached to the post of Joint Director, the post held by the
petitioner. Certain internal communication/miscommunications
of the officers resulted in cause of action to the petitioner to
claim benefit of Rs. 14300-18300. On the other hand, the basic
document relating to the pay revision in the department of
Animal Husbandry and Fisheries Department, it was notified in
the Gazette on 13.02.1999. Extract of Pg. No. 137 reads as

2. The Director post carries pay scale of Rs. 5100
- 6300 - revised pay scale of Rs. 14300 - 18300 at S. No. 5 and
the post of Joint Director is at S.No. 8 carries existing pay scale
of Rs. 3700-5000 revised pay scale Rs. 12000-16500. The
petitioner was unable to produce any amended document to the
above revision of scale of pay. Gazette notification dated
13.02.1999
and to the extent modified pay scale of Joint
Director in the pay scale of Rs. 14300-18300 and it has been
given effect from retrospective date so as to cover the
petitioner's date of retirement as 31.01.1997.
3. In view of these facts and circumstances, the
present contempt petition stands dropped, reserving liberty to
Patna High Court MJC No.43 of 2024 dt.12-08-2024
the petitioner to file afresh writ petition in the event of any
amended Gazette notification to cover the Joint Director pay
scale of Rs. 14300 - 18300 prior to 31.01.1997 the date on
which petitioner retired from Service.
4. Accordingly, the present contempt petition
stands dropped.
