03. 1. The matter is taken up through hybrid mode.

2. Heard Mr. D.C. Dey, learned counsel for the claimant - Appellant and Mr. S. Roy, learned counsel for insurer - Respondent No.2.

3. Mr. Roy submits that deficit court fee in the cross-objection has already been paid on 29th October, 2022. The same is accepted and I.A. No.1076 of 2022 filed praying for time to file the court fee, is disposed of.

4. Mr. Roy further submits that he has filed the authenticated free copy of the impugned judgment received from the tribunal in the cross objection. Accordingly the office note to that effect is ignored.

5. Since the liability of the insurer - Respondent No.2 is neither disputed in the appeal nor in the cross-objection, notice on the owner

- Respondent No.1 is dispensed with for the time being.

6. List the matter on 4th January, 2023.
