Heard Mr. G. Saikia, learned counsel for the applicants and Mr. G. Alam, learned counsel for the opposite party.

2. This IA has been filed for a direction to direct the Axis Bank, Noonmati Page No.# 9/11

and State Bank of India, Vinobanagar Branch to convert the balance lying in certain bank accounts of the applicants, which have been attached by the learned Civil Judge, Sonitpur, Tezpur by order dated 06.07.2015, passed in Misc. (J) case no.13/2011, arising out of MS no.121/2011, be converted to fixed deposit account so that interest may accrue on the balance lying in the said respective accounts.

3. Considered the submission made by the learned counsel for the parties. Also considered the order dated 19.09.2022 passed in FAO 4/2016. Having regard to the fact that by virtue of order of attachment, a sum of Rs.57,40,121.39 is lying idle. Therefore, the Court is of the considered opinion that the said amount directed to be converted into fixed deposit accounts so that the interest that may accrue in such accounts will benefit both sides. The details of the accounts in which the money lying as on the date of attachment before the judgment vide order dated 06.07.2015 are as follows:

4. Therefore in reference of the order dated 06.05.2015 passed by the learned Civil Judge, Sonitpur, Tezpur in Misc. (J). case no.13/2011 in M.S. 12/2011, the Court is inclined to permit the applicants herein to move the respective bank branches mentioned herein before for conversion of the entire balance or effects of four account numbers referred above to be converted into a fix deposit account for a tenure not exceeding 5 years or 60 months. Along with such application, the applicant shall produce a certified copy of this order.

5. The said fixed deposits shall be made in the name of the existing the account holder. However, the concerned banks i.e. Axis Bank and State Bank of India shall put an endorsement on the fixed deposits receipts that the proceeds of such fixed deposit accounts would be kept attached pursuant to order dated 06.07.2015, passed by the learned Civil Judge, Sonitpur, Tezpur in Misc.(J) case no.13/2011 arising out of M.S. 12/2011 as modified by this order.

6. The applicants shall apprise the learned trial Court as to whether this order has been complied with or not. As the connected appeal has been disposed of along with this interlocutory application, the parties are granted liberty to approach the Court of the learned Civil Judge, Sonitpur, Tezpur, for any Page No.# 11/11

consequential orders so as to give effect to this order.

7. This interlocutory application stands allowed to the extent as indicated above.
