IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD
953 CRIMINAL WRIT PETITION NO.1722 OF 2023
ASHWINI KAILAS PATIL
VERSUS
THE STATE OF MAHARASHTRA AND ANOTHER
...
Advocate for Petitioner : Mr. Menezes Joslyn A
APP for Respondent No.1: Mr. A.R. Kale
.....
CORAM : R. G. AVACHAT AND
SANJAY A. DESHMUKH, JJ.
DATED : 30th NOVEMBER, 2023.
PER COURT :-
In our view, the petitioner has equally efficacious remedy to
approach the trial court in view of the Apex Court's judgment in the
case of Sakri Vasu vs. State of U.P. and others, (MANU/
SC/8179/2007). He may avail the same. If any such application is
moved, the same would be decided on its own merits.
2. So far as the grievance about investigating officer is
concerned, the petitioner has remedy under Section 22 of the
Maharashtra Police Act, 1951. He may also avail the same.
3. With the above observations, writ petition stands disposed
of.
