Sri B.B. Upadhyay, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Dheera against the judgment and order dated 22.08.1995 passed by IX Additional District and Sessions Judge, Saharanpur in Sessions Trial No. 707 of 1994, under Section 304-II IPC, Police Station Deoband, District Saharanpur.

As per office report dated 04.02.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 26.11.2021 informed that the appellant - Dheera has died in the year 2002. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
