However, Sri Arunendra, learned Additional Government Advocate for the State-respondent is present.
The instant appeal arises out of judgment and order dated 25.01.2006 passed by the Additional Sessions Judge, Court No.5, Sitapur in Sessions Trial No. 625 of 2003, arising out of Crime No. 192 of 2003 convicting and sentencing the appellant under Section 302 I.P.C. and read with Section 34 I.P.C. for life imprisonment and fine to the tune of Rs.5,000/- and in default of fine, the appellant has been further sentenced for three months rigorous imprisonment.
As per office report dated 25.11.2021, the compliance report from the Chief Judicial Magistrate, Sitapur dated 09.11.2021 has been received. As per report, the sole appellant-Phool Chand has died.
In view of above, the appeal stands abated.
