Order 11/11/2025

1. This writ petition has been filed by the petitioners with the

following prayers:

"(i) the impugned notification dated 05.06.2025 (Ann.13) issued by Dy. Secretary, Department of Revenue (Gr.II), Rajasthan, Jaipur may kindly be declared highly arbitrary, unjust and same may kindly be quashed and set aside.

(ii) The respondents authorities may kindly be restrained from demarcating the land of new revenue village in pursuance of notification dated 05.06.2025.

(iii) Any other appropriate writ, order or direction which this Hon'ble Court deems just and proper may kindly be passed in favour of the petitioners."

2. Learned AAG submits that the controversy involved in the

present writ petition is squarely covered by the Co-ordinate Bench

of this Court vide order dated 23.09.2025 passed in SBCWP

No.14930/2025 along with other connected matters titled as Mala

Ram & Anr. Vs. State of Rajasthan & Ors wherein, the Co-

ordinate Bench has dismissed the writ petition while granting

liberty to the petitioners to file representation before the

competent authority of the State Government within a period of

30 days and the State Authority was directed to consider and

decide the representation as expeditiously as possible.

3. Learned counsel for the petitioners vehemently opposed the

submissions made by the learned AAG, contending that the

present case is distinguishable from Mala Ram (supra). It is

submitted that the petitioners by way of filing the instant petition

are seeking compliance of the Circular dated 20.08.2009 as well

as the guidelines laid down in the order dated 16.02.2025

(Annex.2). He further submits that the action of the respondents

while creating the new revenue village at Oran Land is in utter

violation of the provisions of law, to which, learned AAG submits

that there is no pleading in the writ petition to this extent and

thus no indulgence can be granted to the petitioner on the said

submission.

4. Upon consideration, this Court finds that the controversy

involved in the present matter is squarely covered by the

judgment dated 23.09.2025 rendered in Mala Ram (supra),

wherein the Coordinate Bench had considered and dismissed

similar challenges relating to naming of newly created revenue

villages after particular individuals or influential persons. learned

counsel for the petitioners has failed to demonstrate any

substantial distinction between the present case and the decision

rendered in Mala Ram (supra). Therefore, the reasoning and

principles settled therein apply with equal force to the facts at

hand.

5. Thus in view of the above, the instant writ petition is

dismissed in the same terms as in the case of Mala Ram

(supra). The petitioners would be at liberty to file representation

before the competent authority of the State Government within 30

days from today. In case, a representation(s) are so filed, it is

expected from the concerned State Authority that the same shall

be considered and decided as expeditiously as possible.

6. The stay petition as well as all pending applications, if any,

stand dismissed accordingly.
