19/01/2023 Counsel for petitioner states that petitioner is suspended since 2.8.2021 and on filing the writ petition No.7763/2022, this Court has directed respondents to consider the case of petitioner for revocation of suspension in light of the Judgment of Ajay Kumar Choudhary Vs. Union of India [2015 (7) SCC 291] vide order dated 21.9.2022. However, till date respondents have not passed any order despite his pending representation.

It has been stated that in the order dated 21.9.2022, liberty was given to file fresh writ petition to the petitioner.

Notices be issued to respondents.

Counsel, Dr. V.B. Sharma, AAG has put in appearance on behalf of respondents, hence, service is complete.

Let the matter be listed on 1.2.2023. Till next date, the suspension order dated 2.8.2021 shall remain stayed.

In case, order is not passed in respect of the issue involved herein, the concerned Officer shall remain present in the Court.

Registrar (Judicial) is directed to send copy of this order to Chief Engineer & Additional Secretary, Public Works Department, Jaipur.
