With the consent of the learned counsel for the parties, the

matter is being disposed of finally.

The present writ petition has been filed with the following

prayer:

"By an appropriate writ, order or direction, the impugned judgment-dated 10.08.2018 (Annex.10) passed by the learned Board of Revenue may kindly be quashed and set aside and the judgment dated 05.10.2015 passed by the learned Revenue Appellate Authority, Bikaner (Annex.9) may kindly be upheld."

Learned counsel for the parties have moved an application

for taking the compromise agreement on record. According to the

application preferred, the parties have agreed that the judgment

passed by the Board of Revenue is not sustainable and should be

quashed and the findings of the judgment passed by the Revenue

Appellate Authority, Bikaner dated 05.10.2015 may be upheld.

The application for taking the compromise agreement on

record is allowed.

Learned counsel for the parties are in agreement that the

land in question is in the ownership of the petitioner only and

there is no right or title of the private respondents. It is further

stated that the land in question which was mutated in the name of

the petitioner is correct and valid.

In these circumstances, the writ petition is allowed. The

judgment passed by the Board of Revenue dated 10.08.2018 is

quashed and set aside and the judgment passed by the learned

Revenue Appellate Authority dated 05.10.2015 is upheld.
