The present interim bail application has been filed under

Section 439 Cr.P.C. The petitioner has been arrested in connection

with FIR No.189/2021 Police Station Gangrar, District Chittorgarh

for the offences punishable under Section 8/15 of NDPS Act.

Learned counsel for the petitioner submits that the mother of

the petitioner has been expired on 29.09.2021 and for doing the

last rites of his mother the presence of petitioner is essential. The

petitioner is behind the bars and the trial of the case will take

sufficient long time to be concluded. Therefore, the petitioner may

be enlarged on interim bail.

Learned Public Prosecutor vehemently opposed the interim

bail and submits that the mother of petitioner is died on

29.09.2021 and now all the rituals are completed, therefore,

interim bail may not be granted to the petitioner.

Heard learned counsel for the petitioner as well as learned

Public Prosecutor.

I have considered the arguments advanced before me and

gone through the material available on record.

According to the report submitted by the learned Public

Prosecutor, the mother of petitioner has expired on 29.09.2021

and now the last rites and rituals are completed. In these

circumstances, no case for grant of interim bail is made out.

Hence, the present interim bail application filed by the petitioner is

hereby dismissed.
