From the record, it appears that on 15.01.2021, the criminal

case was finally heard and case was fixed for judgment on

23.02.2021. Order dated 23.02.2021 reveals that since one of the

accused was not present in Court, judgment could not be

pronounced and it was adjourned for 26.02.2021.

On 26.02.2021 again the accused was not present. Hence,

judgment was not pronounced. However, bail bonds of the accused

petitioner was cancelled and warrant of arrest was issued against

the petitioner and proceedings for attachment of bail bonds were

also initiated under Section 446 Cr.P.C.

The order dated 26.02.2021 is under challenge in this

petition.

Learned counsel for the petitioner submits that the matter

was compromised and an application was moved on 26.02.2021

by the counsel for the petitioner for exemption of his personal

appearance.

After hearing the parties, I do not find any illegality with the

impugned order, leading to failure of justice.

The petition is, accordingly, dismissed.

Pending application, if any, also stands disposed of.
