Learned counsel for the petitioner has relied upon the
judgment of Punjab and Haryana High Court passed in CWP No.3359 of
2008 titled as Ram Dulari vs. State of Haryana and Ors., dealing with
identical issue. He submits that the matter is covered by the said
judgment and his petition be allowed.
On behalf of respondent No.2 - Director Pension and
Pensioners Welfare Department, Treasurer, Bharatpur, the author of
Annexure No.7, is directed to remain present before the Court on the
next date of hearing i.e. on 20.04.2022.
Learned officer will apprise the Court with reference to Rule
268F of the Rajasthan Service Rules, 1951. The officer is also directed
to bring the entire record pertaining to the matter during the course of
hearing.
In the light of above, we deem it appropriate to list the
matter for final disposal in supplementary list on 20.04.2022.
