                                                                ORDER

Heard on I.A. No.22400/2024, an application for explaining delay in filing this petition.

It is pointed out that petitioners No.2, 7, 12 & 14 have preferred Writ Petitions before this Court being W.P. Nos.28742/2018, 21293/2018, 14815/2018 & 9790/2018, therefore it cannot be said that they were sleeping over their rights.

This petition is being filed on behalf of 16 petitioners. Despite granting opportunity to explain delay in approaching the Court, learned counsel for petitioners has filed an application for condonation of delay only on behalf of four

petitioners. Apart from the aforesaid, there are no documents on record to show that they have pursued the matter at any point of time. The recruitment drive is of the year 2008 and they slept over their right for considerable period.

Under these circumstances, this Court is not inclined to permit the petitioners to continue this Writ Petition on behalf of remaining petitioners (except petitioners No.2, 7, 12 & 14). Therefore, learned counsel for the petitioners has prayed before this Court that they may be granted liberty to pursue

2 WP-33564-2024 the matter before the Authorities as far as other petitioners (except petitioners No.2, 7, 12 & 14) are concerned.

Accordingly, this petition so far as it relates to petitioners No.1, 3 to 6, 8 to 11, 13, 15 & 16 are concerned, the same is dismissed as withdrawn with liberty as prayed for.

As far as petitioners No.2, 7, 12 & 14 are concerned, they are directed to submit fresh individual representation in the light of judgment passed by Hon'ble Supreme Court in the case of Smita Shrivastava vs. State of M.P. (S.LP (Civil) No.23966-23968/2022) along with all relevant documents including the order passed by the Hon'ble Supreme Court within a period of 15 days from today and in case such a representation is filed, the Competent Authority is directed to dwell upon the same and pass a self contained speaking order within a period of 90 days

thereafter.

Needless to mention that this Court has not expressed any opinion on the merits of the case.

With aforesaid observations, petition so far as petitioners No.2, 7, 12 & 14 are concerned, is finally disposed off .
