Learned counsel for the appellant pressed IA No.19396 of 2023 arising out of judgment dated 23.8.2017 passed in Special Sessions Case No. 170 of 14 by Special Judge (Prevention of Atrocities) Act, Satna.

Learned counsel for the appellant informed that the appellant has undergone nine years actual jail sentence. Since this court has already dismissed the previous application on 2.5.2018 and its a case of gang rape, no case is out for suspension of remaining jail sentence and grant of bail.

Accordingly, IA No.19396 of 2023 is dismissed. At this stage, learned counsel for the appellant prays for posting of appeal for final hearing in the teeth of Section 374 (4) of Cr.P.C., we deem it proper to post this matter for final hearing in the week commencing 28th of November 2023.
