Learned counsel for the petitioner submits that as per the judgment of the Hon'ble Supreme Court in Thumati Venkaiah and others Vs. State of Andhra Pradesh and Others reported in 1984 Supreme Court Cases 295 if

the land is situated within urban agglomeration then the provisions of The Urban Land (Ceiling and Regulation) Act, 1976 would be applicable and if the same is beyond that then M.P. Ceiling on Agriculture Holding Act, 1960 would be applicable.

Learned counsel for the respondent/State prays for time to examine the said aspect.
