Heard on I.A.No.15026/2022, an application for amendment/permission to raise additional substantial questions of law in the memo of appeal.
After due consideration, application is allowed. Appellant is permitted to
raise additional substantial question of law during course of arguments on admission.
Accordingly, I.A.No.15026/2022 is disposed of. Learned counsel for the appellant prays a week's time to argue on admission and also submits that execution proceedings are going on before the executing Court and prays to stay the execution proceedings till next date of hearing.
As an interim measure execution of judgment and decree so far as it relates to delivery part of possession of the disputed property, shall remain
stayed till next date of hearing.
It is made clear that if on the next date of hearing learned counsel for the appellant will not be ready to argue on admission, this order shall be vacated.
As prayed, list in the week commencing 10/07/2023. Certified copy as per rules.
