The State has filed the appeal being aggrieved by judgment dated 13.3.2020 delivered by the learned Special Judge (POCSO Act), Jabalpur in Special Case No.14294/2016, whereby the learned trial Court acquitted the respondent of offence punishable under Sections 354 of I.P.C. and Section 8

of Protection of Children from Sexual Offences Act, 2012, after extending the benefit of doubt.

On 01.03.2021, the Court issued bailable warrant against the respondent and thereafter, on 24.02.2022, the Court again issued bailable warrant against him.

A s per letter of Special Judge (POCSO) Act, Jabalpur dated 11.11.2021, the respondent appeared before the trial Court on 08.11.2021 and he has been taken into custody.

Accordingly, I.A. No.4990/2022 an application for cancellation of warrant stands dismissed as having been rendered infructuous.

Learned counsel for the respondent submits that the respondent is in jail since 08.11.2021, therefore, it is prayed to release the applicant on bail.

Considering the aforesaid facts and circumstances of the case, without commenting on merits of the case, it is directed that on furnishing a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial Court concerned, the respondent - Vishal Jirage shall be released on bail.

The respondent shall appear before the Registry of this Court on 29.07.2022 and on all subsequent dates, as may be fixed by the Office in this regard during the pendency of this appeal.

Accordingly, I.A. No.3662/2022 stands disposed of.
