This third application under Section 439 of Cr.P.C. has been

filed for grant of bail. The second application was dismissed by order

dated 02.02.2022 passed in M.Cr.C. No.1807/2022 with liberty to

revive the prayer alongwith the copies of the judgments.

The applicant has been arrested on 28.10.2021 in connection

with Crime No.171/2020 registered at Police Station Bajrang Garh,

Distt. Guna for offence under Sections 307, 353 r.w. Section 34 of IPC

r.w. Section 41A of Cr.P.C.

It is submitted by Counsel for applicant that according to the

prosecution case, when the police party raided the house of applicant

in connection with an offence registered under Section 379 of IPC,

gunshots were fired on the police party, although no police personnel

had sustained gunshot injury. It is submitted that applicant has been

granted bail in Crime No.698/2020 registered under Section 376-D,

343, 294, 498-A of IPC and Crime No. 183/2020 registered under

Section 379 of IPC. He has already been acquitted in Crime

No.167/2009 registered under Section 302 of IPC. It is submitted that

so far as Crime Nos.64/2011, 12/2011 and 977/2009 are concerned, he

could not get the copies of judgments in spite of his best efforts. The

trial is likely to take sufficiently long time and there is no possibility

of his absconding or tampering with prosecution case. It is further

submitted that in view of the criminal antecedents, the applicant is

ready and willing to abide by any stringent condition which may be

imposed by the Court.

Per contra, the application is opposed by the Counsel for the

State. It is submitted that apart from present case, 6 more criminal

cases have been registered against applicant.

Considering the facts and circumstances of the case and without

commenting on the merits of the case, the application is allowed. It is

directed that the applicant be released on bail on furnishing a personal

bond in the sum of Rs.1,00,000/- (Rupees One Lac Only) with one

surety in the like amount to the satisfaction of the Trial

Court/Committal Court to appear before the Court on the dates given

by the concerned Court.

It is further directed that the applicant shall appear before the

S.H.O. Police Station Bajrang Garh, District Guna on 1 st & 15th of

every month during the pendency of the Trial. In case of bail jump or

non-appearance of the applicant before the police station as directed

by this Court, this order shall lose its effect.

In the light of the judgment passed by the Supreme Court in the

case of Aparna Bhat & Ors. vs. State of M.P. passed on 18/3/2021

in Criminal Appeal No.329/2021, the intimation regarding grant of

bail be sent to the complainant.
