In compliance of order dated 23/05/2022, the present SHO has filed his
affidavit and has pointed out that he took the charge of the police station on
11/05/2022
whereas, the dairy was already sent prior to that.
It is submitted by the counsel for the State that in fact one Pramod Sahu
was the SHO, Police Station Daboh, District Bhind at the relevant time and diary was sent under his signatures.
Accordingly, let an affidavit be filed by the Superintendent of Police, Bhind as to why the important information with regard to the criminal antecedents of the applicant were withheld by Pramod Sahu. The affidavit be filed by latest by 27/06/2022.
From the affidavit filed by SHO, it is clear that the applicant was tried for offence under Sections 302 and 307 of IPC in Crime No.70/2006 as well as in Crime No.28/2016 for offence under Sections 354, 452, 324 and 506 of IPC
and in both the cases, he has been acquitted.
Accordingly, the counsel for the applicant is directed to file the judgment of acquittal passed in the above mentioned two cases.
