Shri Manoj Kushwaha, panel lawyer for the State. Nobody has appeared on behalf of the petitioner on 03.12.2021. An objection is being taken by the counsel appearing for the
respondent no.1/Railways that the petition seeking appointment in the Central Government Agency is not maintainable before this Court in view of the judgment passed by the Supreme Court in the case of L. Chandra Kumar Vs. Union of India and others reported in (1997) 3 SCC 261. He has to claim before the Central Administrative Tribunal.
In view of the aforesaid, as the petition itself is not maintainable, the same is dismissed being not maintainable. However, a liberty is extended to the petitioner to file proper proceedings before the Central Administrative Tribunal, if he so desires.
Disposed of accordingly.
