                Shri Pramod       Pachouri,       learned    Public   Prosecutor,   for   the
         respondent/State.

Learned counsel for the applicant prays for withdrawal of this first bail application filed under Section 438 of Cr.P.C. in connection with Crime

No.202/2021 registered at Police Station Pichor, District Gwalior for the offence under Section 34 and added Section 49(A) of M.P. Excise Act in the light of the judgment passed in the case of Siddharth Vs. State of U.P. in Cr.A.No.838/2021, Amanpreet Singh Vs. CBI in Cr.A.No.929/2021 and the High Court Circular No.A/38 dated 11/10/2021 as the applicant was earlier granted bail for commission of offence under Section 34 of M.P. Excise Act.

In the light of aforesaid, prayer is allowed. Accordingly, the present anticipatory bail application stands dismissed

as withdrawn.

It is expected that observations passed in aforesaid judgments shall be followed.
