Heard the parties.

Learned counsel for the appellant submits that this interlocutory application has been filed with the prayer to grant leave to the appellant to present this acquittal appeal. It is next submitted that the appellant was the complainant of Complaint Case No. 69 of 2013 of the court of learned Judicial Magistrate 1st Class, East Singhbhum at Jamshedpur and the respondent no.2 and two other co-accused persons were convicted under Sections 420/34 of the Indian Penal Code by the learned Judicial Magistrate 1st Class, East Singhbhum at Jamshedpur vide judgment dated 03.09.2022 but the learned Additional Sessions Judge-IV, East Singhbhum at Jamshedpur vide impugned judgment dated 27.05.2024 in Criminal Appeal No.162 of 2022 allowed the said criminal appeal and acquitted the respondent no.2 of the charges arbitrarily. It is next submitted that unless leave is granted to the appellant to present this appeal, the appellant will be highly prejudiced.

Considering the aforesaid facts, leave is granted to the appellant to present this appeal.

This interlocutory application is disposed of accordingly.
