Mr. Prakash Chandra, learned counsel for the
petitioner has submitted that though the law has been
settled by Hon'ble Apex Court in the judgment rendered in
Jitendra Kumar Srivastava Vs. State of Jharkhand &
Ors [(2013) 12 SCC 210] but the pensionary benefit has
not been extended to the petitioner in the garb of initiation
of departmental/judicial proceeding.
Upon this, learned counsel for the State has
submitted that the since the law has already been settled,
the matter may be referred to the Lok Adalat.
Considering the aforesaid submission, let the
matter be placed before the National Lok Adalat scheduled
to be held on 12th November, 2022.
Office is directed to communicate the order to the
Principal Secretary, School Education and Literacy
Department, Govt. of Jharkhand forthwith so that the
competent authority may be directed to participate in the
Lok Adalat on the scheduled date.
