The petitioner is the complainant who instituted PCR Case No.98 of 2008 which was converted into TR Case No. 677 of 2015.

The judgment of conviction of OP No. 2 under section 138 of the Negotiable Instruments Act and under section 420 of the Indian Penal Code have been set aside by the Sessions Judge in Criminal Appeal No. 51 of 2015.

The petitioner is aggrieved of the judgment dated 28th March 2016 passed in Criminal Appeal No. 51 of 2015.

The proceedings in this criminal revision petition indicate that the petitioner is not serious to prosecute the matter.

On 06th April 2021 even on repeated calls no one appeared for the petitioner. On 17th February 2022, Mr. Akash Kr. Lal, the learned counsel appeared and made a request for adjournment on the ground of personal difficulty of Mr. Vikram Sinha, the learned counsel for the petitioner.

On 11th March 2022, Mr. Vikram Sinha, the learned counsel for the petitioner informed the Court that during pendency of the criminal revision petition OP No. 2 has died and, therefore, the matter was adjourned for enabling the parties for filing substitution of OP No. 2.

Once again no one appears for the petitioner. Criminal Revision No. 663 of 2016 is dismissed in default.
