                                    ORDER

1. By this application, the applicant herein is seeking impleadment of Sh.

Kumar Rajeev Ranjan (IAS), Administrative Secretary Revenue

Department as party respondent no. 9.

2. The application, for the reasons stated herein, is allowed and Mr.

Kumar Rajeev Ranjan is impleaded as party respondent in the contempt

petition.

3. Registry to update the cause title of this contempt petition.

1. This is a petition for initiating contempt proceedings against the

respondents for willful disobedience and non-compliance of judgment

dated 19.10.2022 passed in WP (C) No. 1034/2022 along with other

clubbed matters, whereby a direction was issued to the Union of India CCP (D) No. 14/2023 in WP (C) No. 1034/2022 c/w

to acquire the land of the petitioners under their possession, by

following the due process of law.

2. The compliance report on behalf of the Union of India has been filed, a

perusal whereof would indicate that the Union of India have completed

requisite formalities and already placed an indent before the Collector

Land Acquisition. It is now for the Collector Land Acquisition

concerned and also the Administrative Secretary to the Government of

J & K, Department of Revenue which has to take the follow up action,

strictly under the Land Acquisition Laws in force.

3. In view of the aforesaid, we are of the considered opinion that the

judgment passed by this Court is substantially complied insofar as the

Union of India is concerned and the process of acquisition is required to

be undertaken and completed by the Collector Land Acquisition

concerned within the time stipulated in the Act.

4. It is brought to our notice that the process of acquisition would be

formally initiated by the Collector Land Acquisition only after the

matter is processed and referred to the Secretary to the Government of J

& K, Department of Revenue for issuance of notification to the land

owners and also completing other requisite statutory formalities.

5. Be that as it may, the fact remains that the judgment passed by this

Court has been substantially complied with and the process for

acquisition has already been set in motion. We, therefore dispose of this

contempt petition by providing that the requisite steps, which are

required to be taken by the Collector Land Acquisition as well as the

Secretary to the Government of J & K, Department of Revenue, shall

be taken without any further waste of time and the process shall be CCP (D) No. 14/2023 in WP (C) No. 1034/2022 c/w

formally initiated within a period of two months from the date copy of

this order is served to the Collector Land Acquisition and Secretary to

the Government of J & K, Department of Revenue.

6. Needless to say that in case there is any laxity or neglect on the part of

the aforesaid authorities to conclude the acquisition process within a

period of six months, the petitioner shall be free to approach this Court

again.
