The judgment rendered in SWP No. 780/2010 makes it clear that the policy is regarding providing employment to the persons whose land to the extent of 75% or more has been acquired by the Railways. The order makes it clear that the policy is not to be taken as applicable to the future acquisitions, but had a retrospective operation.
Secondly, the judgment makes it clear that one member of the family is to be provided employment and it does not disentitle the petitioner. The judgment has specifically dealt with both the issues which are being raised by the respondents for not providing the employment. The earlier compliance report filed already stands rejected vide order dated 06.09.2023.
Mr. Vishal Sharma, learned DSGI is directed to file fresh compliance report indicating compliance in letter and spirit by taking into consideration the observations and directions passed by the writ court referred above. List on 16.12.2024.
