Heard learned counsel for the parties and perused the record.

From the pleading of the parties, following substantial questions of

law emerg for consideration of this Court:-

(i) Whether the Appellate Court failed to frame points for

determination in the appeal while overlooking the pleadings of

parties, law on the subject and issues framed by the Trial Court

thereof?

(ii) Whether the Appellate Court failed to appreciate the

controversy involved in the case set up by the respective parties

on the question of fraud overlooking the evidence led in the

matter, and in the process committed perversity while passing

the impugned judgment and decree?

List the main appeal for consideration on 17.08.2021.

Interim order dated 09.10.2017 shall remain in operation till final

disposal of the appeal.
