of Petitioner in person. It is pointed out by Mr. M.A.
Safee, Advocate that after passing of the order by this Court on rt 10.02.2026, the petitioner has started to make addition or
alteration/repair/reconstruction over the suit property. Mr. Nimish
Gupta, Advocate, on instruction states that his client was not
aware that he cannot raise further construction. Henceforth, he
shall stop construction on the spot. Mr. M.A. Safee, Advocate
submits that he wants to rebut the report filed by the petitioner
dated 12.02.2026. He seeks three weeks' time to do the needful.
Respondent is permitted to rebut the report as filed by the
petitioner.
In the meantime, during the course of day, the
petitioner shall file an undertaking before this Court by stating
that in case any loss or damage occurs in future to the adjacent
properties, he shall be responsible for the loss/damage and he
shall be liable to pay compensation to the affected parties.
