2. Mr. Ankit Diwan, Advocate appearing vice for the

respondents, under instructions of Standing Counsel

Mr. Shyam Singh Chauhan, Advocate, waives service of notice

on behalf of the respondents. On the basis of instructions

imparted to him on behalf of the respondents, he further

admits that the present case is squarely covered by

judgment dated 17.7.2014 passed by this Court in CWP

No. 3050 of 2014 titled as Nek Ram Versus State of

Himachal Pradesh and others, as claimed by the petitioner

in the petition.

3. In view of above, the present petition is disposed

of with the observation that judgment passed in

CWP No.3050 of 2014 (supra) shall be applicable mutatis

and mutandis to the present case and accordingly the

respondents r are directed to release all the pensionary/

retiral benefits to the petitioner within a period of three

months from today and thereafter pension to the petitioner

shall be released regularly on the first day of each month and

petitioner shall also be entitled for interest on pensionary

benefits @ 9% per annum from due date.

Pending miscellaneous application(s), shall also

stand disposed of with no order as to costs.
