Mr. S. Biswas, learned counsel for the petitioner submits that the present matter is squarely covered by the judgment and order dated 12.08.2021 passed in WP(C) No.8694/2018 (Sukumar Sarkar & Ors. v. State of Assam & Ors.).

Mr. A. Phukan, learned standing counsel for the Education (Elementary) Department prays that he may be granted 2(two) weeks' time to file affidavit-in- opposition as well as to go through the judgment relied by the learned counsel for the petitioner.

Prayer is accordingly allowed.
