Learned counsel for the applicant submits that due to inadvertence the prayer has been wrongly mentioned.

Learned counsel for the applicant is permitted to correct the same during the course of hearing.

Sri Krishna Gopal Singh, learned counsel for the applicant and Sri Vijay Kumar, learned A.G.A. Ist for the State are present.

The present application u/s 482 of Cr.P.C. has been filed with a prayer to modify the order dated 16.07.2024 passed by Additional Principal Judge, Family Court, Farrukhabad in Case No. 115/12 of 2021 (Smt. Anjali @ Aarti vs. Vivek Rajpoot), whereby an application under Section 126 (2) of Cr.P.C. has been allowed and the opposite party no. 2 has been awarded Rs. 30,000/- as cost.

Learned counsel for the applicant wants to adjust the cost of maintenance awarded by the court in favour of opposite no. 2 in the ex-parte judgment.

In view of the above facts and circumstances, Rs. 15,000/- should be adjusted in maintenance, which has been awarded by the court in earlier order and remaining Rs. 15,000/- is payable as cost to opposite party no. 2 within two weeks from the date of production of a certified copy of this order.

Accordingly, this application is disposed of.
