1. Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present.

2. The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 29.5.2004 passed by Addl. Sessions Judge/F.T.C. No.2, Siddharthnagar in S.T. No.119 of 1997.

3. As per the office report dated 27.5.2023, a report of C.J.M., Siddharthnagar dated 21.4.2023 has been received stating therein that the sole appellant Phoolmati Devi has died on 23.12.2009. The said report has been sent after due inquiry.

4. This Court has perused the said report which states that the accused-appellant Phoolmati Devi has died on 23.12.2009.

5. In view of the above, the appeal stands abated.

6. File consigned to records.

7. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
