3. Sri Bade Lal Bind, learned State counsel is present, who has been heard.

4. The present appeal has been filed by the appellant Ganga Saran against the judgment and order dated 12.04.2006 passed by Additional Sessions Judge/FTC, Bulandshahr in Sessions Trial No. 223 of 2004, Police Station Sikandrabad, District Bulandshahar.

5. As per office report dated 11.07.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 14.06.2023 informed that the appellant - Ganga Saran has died in the year 2015 due to an accident. In support of which a report of concerned police station and the copy of death certificate issued by Government of Uttar Pradesh and the copy of the statements of the other witnesses have also been annexed thereto.

6. Accordingly, the appeal stands abated.

7. Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
