3. Sri Ajay Singh, learned State counsel is present, who has been heard.

4. The present appeal has been filed by the appellant Shakil @ Chota against the judgment and order dated 15.02.2006 passed by Additional Sessions Judge/FTC-III in Sessions Trial No. 822 of 2005, Police Station Samli, District Muzaffar Nagar.

5. As per office report dated 19.10.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 20.02.2020 informed that the appellant - Shakil @ Chota has died on 18/19.09.2019 in jail during treatment. In support of which a report of concerned police station has been annexed.

6. Accordingly, the appeal stands abated.

7. Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
