Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

This application under Section 482, Cr.P.C. has been preferred for quashing the judgment and order dated 24.06.2022 passed by the Principal Judge, Family Court, Jaunpur in Criminal Misc. Case No. 848 of 2022, under Section 126(2) Cr.P.C., whereby the amount of Rs. 25,000/- has been awarded as cost.

In the instant case, the Principal Judge, Family Court allowed the application moved by the applicant under Section 126(2), Cr.P.C. and recalled the order dated 05.02.2022 passed under Section 125, Cr.P.C. imposing cost of Rs. 25,000/-.

Having considered the facts, evidence and circumstances of the case, I am of the view that impugned order should be modified and the amount of cost should be reduced from Rs. 25,000/- to Rs. 5,000/-.

Consequently, the present application is disposed of. The amount of cost is reduced from Rs. 25,000/- to Rs. 5,000/-.
