Learned counsel for the petitioner submits that he has been

extended actual benefits from the date of completion of two years

of probation period; whereas, some other similarly situated

employees were extended the same benefit from the date of their

appointment. He, therefore, prays that the respondents may be

directed to purge the contempt and they may also be punished

suitably.

Per contra, learned counsel for the respondents submits that

although, some of the similarly situated employees came to be

extended actual benefits from the date of appointment rather than

from the date of completion of two years of probation period; but,

later on, benefits have been withdrawn and they have also been

extended actual benefits from the date of completion of two years

of probation period. He, therefore, prays for dismissal of the

contempt petition.

Heard. Considered.

Since, the only grievance raised by the learned counsel for

the petitioner survives no more in view of the statement made by

the learned counsel for the respondents, this contempt petition is

dismissed.
