Counsel for appellant submits that in respect of the gully in

question, the trial court, vide judgment and decree dated

23.11.2004, issued mandatory injunction for removal of the dodas

raised by defendants, but in the first appeal the decree dated

23.11.2004 has been reversed by the first appellate court vide

judgment and decree dated 30.10.2018.
