Heard learned counsel for the appellant as well as learned

Public Prosecutor and perused the judgment impugned available

on record.

This Court is of the opinion that there are valid and

substantial grounds for grant of leave to the appellant for filing an

appeal against the acquittal of the respondent No.2 vide impugned

judgment.

Accordingly, the application for grant of leave to appeal is

allowed. The memo of leave to appeal be treated as an appeal and

it be registered as such. The accuses-respondent is represented

by his counsel, thus, notice need not be issued to him. He is

directed to mark his presence on or before 05.01.2023 before

Registrar (Judicial), Rajasthan High Court, Jodpur.

Admit. Record of the case has already been received.
