                                                                                   ORDER

The present writ petition under Article 226 of the Constitution of India has been preferred by he petitioner seeking following reliefs:-

"Hence, it is humbly prayed that the Writ Petition may kindly be allowed and writ of mandamus or any other writ, order or direction may kindly be issued against the respondents directing the respondent No. 2 to take up the document submitted by the petitioner company bearing slot ID No. 20022600303431 and 20022600302968 on 23.02.2026 and register the document or to assign the reasons in writing as provided under Section 52 & 71 of the Indian Registration Act within the time fixed by this Hon'ble Court. Any other writ, order or direction as this Hon'ble Court may deem fit in the facts and circumstances of the case, doing justice in the matter be granted."

2. Learned counsel for the petitioner has submitted before this Court that the petitioner, which is a registered company under the Companies Act is owner of the

agriculture land bearing survey No.1021(162/485) situated at village Sirsa Tehsil Dabra, District Gwalior and Survey No.1849, situated at village Mehgaon, Tehsil Dabra District Gwalior. He further submits that by way of two separate registered sale deeds the aforesaid survey numbers have been sold to the purchasers and the said sale deeds have been presented for its registration to respondent No.2 on 23.02.2026 through service provider and Slot Nos.20022600303431 and

2 WP-9814-2026 20022600302968 were allotted to the petitioner/company by the office of Sub Registrar but till date neither the document as submitted by the petitioner had been registered nor any order refusing said document had been passed.

Learned senior counsel submits that if directions are issued to respondent No.2 to take appropriate decision on the aforesaid document i.e. either register the same or pass an order refusing their registration within a time bound frame, the grievance of the petitioner would be redressed. In support of this contention, learned counsel has placed reliance in the matter of Nicer Green Housing and Infrastructure & another Vs The State of M.P. & others passed in writ petition No.19752/2019 (08.09.2021) and has submitted that once a document of registration is submitted then Sub Registrar has to follow the procedure laid down in Section 52 and 71 of the Registration Act,1940. Thus, it is prayed that the

directions as sought may be issued to the respondent No.2.

4. Learned counsel for the State on the other hand submitted that if such directions are issued to the respondent No.2/Sub-Registrar, the compliance thereof would be made within a time period given by this Court.

In the light of aforesaid discussion and in view of provisions contained under Sections 52 and 71 of the Registration Act,1940, this Court deems it expedient to dispose of this petition with direction to respondent No.2/Sub- Registrar to take appropriate decision with regard to documents submitted by the petitioner/company within a period of three days from today.
