The appeal is admitted on the following substantial questions of law:
"(1) Whether learned first appellate Court erred in law in
decreeing the suit in favour of the plaintiff and granting relief
which was not sought by the plaintiff.
(2) Whether the findings of the Courts below in respect to
limitation is perverse?
Issue notice to the respondents on payment of process fee by Registered
as well as Ordinary mode within seven working days. Notice be made returnable within four weeks.
In view of facts and circumstances of this case, till the next date of hearing, the effect and implementation of judgment and decree of the first appellate Court dated 10.12.2021 passed in RCA No. 500075/2016 shall remain stayed.
List this case for final hearing in due course. Certified copy as per rules.
