Heard on I.A.No.30231/2021, which is an application for suspension of jail sentence of the appellant who has been convicted by the Sessions Judge (West Nimar) Mandleshwar, vide judgment

dt.30.11.2021, for commission of offence punishable under Section 324 of IPC, sentenced to undergo 1 year RI with fine of Rs.5000/-, with default stipulation.

Learned counsel for the appellant submits that during the pendency of appeal the appellant was on bail and he has not misused the liberty granted to him by the Court below. It is submitted that the disposal of the appeal shall take long time to conclude. Hence, it is prayed that application for suspension of jail sentence be allowed.

On the other hand, learned Panel Lawyer for the State opposed the prayer for suspension of jail sentence and prays for its rejection.

On due consideration, without expressing any opinion on merits of the case, I.A.No.30231/2021 is allowed and it is directed that upon appellant's depositing the fine amount (if not already deposited) and on furnishing a personal bond to the tune of Rs.50,000/- with one solvent surety in the like amount to the satisfaction of the trial Court, the substantive jail sentence of the appellant shall remain suspended till the final disposal of the appeal and he shall be released on bail, for his regular appearance before the Registry of this court on 10.2.2022 and all other subsequent dates, as may be fixed in this behalf by the Signature Not VerifiedDigitally signed by SAN SHAILESH MAHADEV SUKHDEVE Date: 2022.01.05 17:08:10 IST 2 CRA-8088-2021 Office.
