09 /18.11.2025: I.A. No.8165 of 2025 By filing this interlocutory application, the appellant, namely, Arvind Bharti has renewed his prayer to suspend the sentence and release him on bail during the pendency of this appeal.

2. The appellant has been convicted and sentenced in connection with N.D.P.S. Case No. 33 of 2021, arising out of Kunda P.S. Case No. 15 of 2019 for the offence under Section 18(b) of NDPS Act. He has been sentenced to undergo rigorous imprisonment for 10 years under Section 18(b) of NDPS Act amongst other sentences.

3. Heard, the learned counsel for the appellant and learned A.P.P. for the State and have gone through the impugned judgment, the evidence and the Trial Court Records.

4. Opportunity was given to the State to oppose the bail, which the State availed and opposed.

5. The other co-appellants have already been enlarged on bail after suspension of sentence. The sentence in this case is for 10 years and appellant has remained in custody for nearly half of the sentence. The sentence is also for a fixed period. The appeal has already been admitted and in near future there is no likelihood of this appeal to be taken up for final hearing. Thus, considering the fact that the other co-appellants have been enlarged on bail vide order dated 21.04.2025 in Cr. Appeal (D.B.) No.472 of 2022 and order dated 28.04.2025 in Cr. Appeal (D.B.) No.600 of 2022 and also the fact that this appeal cannot be taken up in near future and the appellant has remained in custody for nearly half the sentence, appellant, named above is directed to be released on bail during the pendency of this appeal, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, NDPS Cases, Chatra, in connection with N.D.P.S. Case No. 33 of 2021, arising out of Kunda P.S. Case No. 15 of 2019 with a condition that one of the bailers must be a close relative of the appellant and with a further condition that the appellant shall appear and mark his attendance before the Registrar, Civil Court, Chatra once in every six months till the disposal of this appeal.

6. Accordingly, the instant interlocutory application being I.A. No.8165 of 2025 stands allowed.
