15/12.11.2025 Learned counsel for the petitioner submits that the matter is arising
under Section 138 of the Negotiable Instrument Act. He further submits that
the learned trial court has been pleased to direct the petitioner to pay
compensation of Rs.5 Lakhs and further directed to undergo S.I. for one year
with payment of fine of Rs.10,000/- and if payment of fine is not made,
further S.I. for one month. He then submits that the said judgment of the
trial court has also been affirmed by the appellate court. He next submits that
the petitioner has moved before this Court by way of filing the present
criminal revision petition. He also submits that the petition for exemption from
surrender has been filed in the form of I.A. No.8279 of 2024. He further
submits that the Co-ordinate Bench of this Court vide order dated 17.06.2025
directed the petitioner to deposit demand draft of Rs.1 Lakhs and interim
protection was provided to the petitioner. He then submits that the sum of
Rs.1 Lakh has already been deposited before the learned trial court and the
same has been disbursed in favour of the complainant. He submits that by
-1- Criminal Revision No. 635 of 2024 order dated 17.06.2025, the petitioner was directed to deposit demand draft
of Rs.1 Lakh in the name of opposite party no.2 in the office of the learned
Registrar General, which has already been deposited by the petitioner. He
next submits that the petitioner has met with an accident and he has not
been able to move and, as such, for further negotiation with the complainant
for compromise, two months' time may kindly be allowed.
2. In view of the above and considering that the matter is arising out of
Section 138 of the Negotiable Instrument Act and the petitioner has already
deposited the sum of Rs.1 Lakh before the learned trial court, which has been
disbursed to opposite party no.2-complainant and the petitioner has also
deposited demand draft of Rs.1 Lakh before the learned Registrar General in
terms of the order dated 17.06.2025 and in that view of the matter, the said
I.A., filed for exemption from surrender is, hereby, allowed. The petitioner is
exempted from surrender before the learned Court in connection with
Complaint Case No.681 of 2017.
3. Accordingly, I.A. No.8279 of 2024 is disposed of.
4. Further two months' time, as prayed for, is allowed to the petitioner to
sit along with the complainant and compromise the matter.
5. Let this matter appear after two months.
