03/15.07.2022 Heard Mr. Ankit Vishal, learned counsel for the petitioners and Ms. Shivani Jaluka, learned A.C. to A.S.G.I. appearing for the N.C.B.
The prayer for bail of the petitioners was earlier rejected at that stage in B.A. No. 13016 of 2021.
Submission has been advanced by the learned counsel for the petitioners that the petitioners are in custody for more than 11 months. He has also relied upon the judgment passed by the Hon'ble Allahabad High Court in Cr. Misc. Writ Petition No. 8403 of 2021.
Learned A.C. to A.S.G.I. for the N.C.B has submitted that against the said judgment the N.C.B. intends to prefer an appeal before the Hon'ble Supreme Court. Learned counsel also submits that 798 bottles of codeine based Phensydyl cough syrup were recovered which is a commercial quantity and therefore the petitioners do not deserve to be granted bail.
On consideration of the fact that huge quantity of Phensydyl cough syrup were recovered and the same indeed appears to contain commercial quantity of codeine phosphate, I am not inclined to reconsider the prayer for bail of the petitioners which stands rejected once again with a direction to the learned trial court to expedite the trial.
