This revision petition has been filed against the judgment of conviction and sentenced affirmed by Additional Sessions Judge-III, Bermo at Tenughat in Cr. Appeal No.128 of 2017 whereby and whereunder the appellant was held guilty under Section 498A of the I.P.C. and was sentenced to undergo simple imprisonment for three years and fine of Rs.5000/- and in default of payment of fine, imprisonment for one month and one year S.I. under Section 323 of the I.P.C.
Aggrieved by the order, the petitioner preferred the appeal. Learned counsel on behalf of State earlier informed that the petitioner has already died and in pursuance to it, a counter affidavit has also been filed on behalf of State that as per report submitted by the Officer-in-Charge, Nawadih P.S., Bokaro vide Memo No.1797 of 2022, petitioner died on 15.08.2022 and the certificate regarding his death has already been issued by the Mukhiya.
Considering the counter affidavit and the information furnished on behalf of the petitioner, instant revision petition abates. I.A. No.6099 of 2022 is disposed of and the Cr. Revision stands dismissed as abated.
