1. Respondent No. 1-Colonel Shiv Choudhary (Chairman, Sainik Cooperative
House Building Society Ltd., Jammu) and respondent No. 2-Mr. Ratan Lal
(Secretary, Sainik Cooperative House Building Society Ltd., Jammu) are
present in person.
2. This court has taken a strong note in the instant contempt petition that the
same is pending before this Court for the last 18 years in which the
order/judgment passed by the learned writ Court has not been complied with
till date by the respondents. It is very shocking that the instant contempt
petition is pending before this Court for the last 18 years and the
order/judgment passed by the learned writ Court has not been complied with
by the respondents. The order, which was required to be complied within a
period of six months, has not been complied with even after 18 years and
still the respondents are showing courage to this Court to seek further time in
complying the Court order. The record reveals that vide order dated
07.10.2025, this Court before framing rule against the respondents had
granted one last and final opportunity to respondent No. 1-Chairman, Sainik
Cooperative House Building Society Ltd., Jammu and respondent No. 2-
Secretary, Sainik Cooperative House Building Society Ltd., Jammu to
implement the order/judgment passed by this Court, failing which, they were
directed to appear in person on the next date.
3. In spite of order passed by this Court dated 07.10.2025, the order/judgment
passed by the learned writ Court has not been complied with.
4. The respondents, who are present in person have assured the Court that they
will comply the order/judgment passed by this Court and, accordingly,
sought one week further time to come with final compliance. This Court in
the light of the assurance is showing leniency and is deferring the matter till
17.10.2025.
5. In light of the assurance extended and the statement made before this Court
by the respondent No. 1-Chairman, Sainik Cooperative House Building
Society Ltd., Jammu and respondent No. 2-Secretary, Sainik Cooperative
House Building Society Ltd., Jammu, this Court deems it proper to defer the
matter till 17.10.2025. On the next date of hearing, the respondents shall
come up with the final compliance of the order/judgment passed by this
Court, failing which, both the respondents shall remain present in person and
in that eventuality, this Court will be constrained to frame rule against the
said respondents.
6. List this matter on 17.10.2025, higher up in the cause list.
