This is an application seeking leave to file an appeal.

I have heard learned counsel for the applicant/appellant and have

also gone through the impugned judgment.

The applicant has succeeded in showing a ground for granting leave

to him for filing the appeal. The application is allowed and the applicant is

granted leave to file appeal against the impugned judgment.
